Brainbite Terms and End User License Agreement

Agreement

These Terms and End User License Agreement ("Terms") govern your use of Brainbite, a mobile trivia game published by Namleh Studios, LLC. By installing or using Brainbite, you agree to these Terms.

These Terms are between you and Namleh Studios, LLC only, not Apple, Google, or any other app store provider. Namleh Studios, LLC is responsible for Brainbite and its content, subject to these Terms and applicable law.

License

Namleh Studios, LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Brainbite for personal, non-commercial entertainment purposes on devices you own or control, subject to these Terms and the applicable app store rules. For Apple devices, this license is limited to use on Apple-branded products that you own or control, and as permitted by the Apple Media Services Terms and Conditions, including Family Sharing or volume purchasing where applicable.

Ownership

Brainbite, including its software, trivia questions, question packs, generated and curated content, artwork, music, sounds, names, designs, themes, seasons, and other content, is owned by Namleh Studios, LLC or its licensors and is protected by intellectual property laws. These Terms do not grant you ownership of Brainbite or its content.

Acceptable Use

Accounts, Progress, and Content

Brainbite may use account sign-in, cloud save, no-repeat question history, custom topic entry, generated question services, and other backend features. We may update, rebalance, add, remove, replace, or moderate questions, seasons, topics, rewards, progression, and features to improve the game, fix errors, protect the service, or comply with platform and legal requirements.

Ads, Purchases, and Subscriptions

Brainbite may include advertising, rewarded ads, subscriptions, season passes, consumable items, lifetime ad removal, bundles, and other in-app purchases. Purchases and subscriptions are handled by the applicable app store or payment provider and are subject to their payment, refund, renewal, cancellation, and family-sharing rules. We do not guarantee that any season, question set, reward, price, entitlement, or feature will remain available or unchanged forever.

Maintenance and Support

Namleh Studios, LLC is responsible for providing maintenance and support for Brainbite as described in these Terms or as required by applicable law. Apple and Google have no obligation to provide maintenance or support services for Brainbite.

Third-Party Services

Brainbite may use third-party services for authentication, cloud save, analytics, diagnostics, question generation, content delivery, advertising, payments, subscriptions, platform features, and abuse prevention. Your use of Brainbite may also be subject to Apple App Store, Google Play, device manufacturer, carrier, network, payment, advertising, and service-provider terms. You agree to comply with applicable third-party terms when using Brainbite.

Privacy

Our collection and use of information is described in the Brainbite Privacy Policy.

Disclaimer

Brainbite is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the game, backend services, accounts, generated questions, purchases, ads, or content delivery will be uninterrupted, error-free, or available on every device or in every region.

To the extent any warranty cannot be disclaimed under applicable law, Namleh Studios, LLC is solely responsible for that warranty. For Brainbite downloaded through Apple's App Store, if Brainbite fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the fullest extent permitted by law, Apple has no other warranty obligation for Brainbite.

Limitation of Liability

To the fullest extent permitted by law, Namleh Studios, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Brainbite.

Namleh Studios, LLC, not Apple or Google, is responsible for addressing claims relating to Brainbite or your possession and use of Brainbite, including product liability claims, legal or regulatory claims, consumer protection claims, privacy claims, and similar claims, except to the extent applicable law provides otherwise.

Intellectual Property Claims

If a third party claims that Brainbite or your possession and use of Brainbite infringes that third party's intellectual property rights, Namleh Studios, LLC, not Apple or Google, is responsible for investigating, defending, settling, and discharging the claim.

Legal Compliance

You represent and warrant that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as supporting terrorism, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Termination

We may suspend or terminate your license to use Brainbite if you violate these Terms, misuse backend services, abuse payments or ads, or interfere with the game or other players. You may stop using Brainbite at any time by deleting the app from your device.

Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last Updated" date at the top of this page.

Apple Third-Party Beneficiary

If you download Brainbite through Apple's App Store, Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
